Kulture House Dubai maintains the https://kulturehousedubai.com/ Website ("Site"). The following are the Terms of Use that govern the use of the Site ("Terms of Use"). By using the Site you expressly agree to be bound by these Terms of Use and the Kulture House Dubai privacy policy and to follow these Terms of Use and all applicable laws and regulations governing the use of the Site. Kulture House Dubai reserves the right to change these Terms of Use at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. We will notify you when there are updates to this page at the bottom of the Terms of Use Notice. If you violate these Terms of Use, Kulture House Dubai may terminate your use of the Site, bar you from future use of the Site, and/or take appropriate legal action against you.
You agree that the fact that these Terms of Use are in electronic format does not affect in any way their validity or enforceability.

Terminology
In these Terms of Use, the following expressions have the meanings set out alongside:
‘account’ means an online Kulture House Dubai account maintained by a member ‘customer’ refers to any person purchasing an item listed on the website ‘intellectual property rights’ means any and all trademarks, rights in designs, trade, business or domain names, copyrights, future copyrights, patents, rights in databases (whether registered or not and any applications to register or rights to apply for registration of any of the foregoing) rights in inventions, know-how, trade secrets and other confidential information and all other intellectual property rights of a similar or corresponding nature that may now or in the future subsist in any part of the world, belonging to Kulture House Dubai;

‘member’ means a registered member/buyer/user of Kulture House Dubai

Copyright Policy
We reserve all our intellectual property rights with respect to the website and the services.
This website contains registered and other intellectual property rights belonging to Kulture House Dubai and you shall not reverse engineer or otherwise attempt to discover any source code contained in the website or any software or database connected to the website.
Kulture House Dubai may terminate the privileges of any user who uses this Site to unlawfully transmit copyrighted material without a license, express consent, valid defence or fair use exemption to do so. If you submit information to this Site, you warrant that the information does not infringe the copyrights or other rights of third parties.

The On-line Materials are Kulture House Dubai’s intellectual property and are protected by the U.S. and international intellectual property laws. The On-line Materials may not be copied or redistributed either in whole or in part without the prior written consent of Kulture House Dubai, except as expressly and specifically permitted under these Terms of Use.

The On-line Materials are and will remain the exclusive property of Kulture House Dubai. All rights, titles and interests in and to the On-line Materials will be and remain vested solely in Kulture House Dubai. Under no circumstances will you have any right, directly or indirectly, to own, use, reproduce, distribute, copy, loan, sell, rent, lease, display, publish, encumber, license, sublicense, redistribute, assign or otherwise commercialize to convey the On-line Materials, or any rights thereto, except as expressly and specifically provided in the Terms of Use. Nothing in these Terms of Use will convey to you any right, title or interest, except that of a license with the express rights and subject to all limitations herein. Nothing in these Terms of Use grants you the right, directly or indirectly, to use the On-line Materials to create a product for resale or to use the On-line Materials in any way that competes with Kulture House Dubai.

You acknowledge and agree that Kulture House Dubai will own all rights, titles and interests in and to any copy, translation, modification, adaptation, derivative work or improvement of the On-line Materials made by or for you. At Kulture House Dubai’s request, you must execute, or obtain the execution of, any instrument that may be necessary to assign these rights, titles or interests to Kulture House Dubai or perfect these rights, titles or interests in Kulture House Dubai’s name.

We are not responsible to you or anybody else for any loss incurred in relation to your use of this website. Your use of this site is at your own risk.

 Indemnity
You agree to indemnify and hold harmless Kulture House Dubai, its affiliates, subsidiaries, shareholders, officers, directors, employees, agents and subcontractors from any claims, actions, demands, damages, liabilities, losses, costs and/or consequences of any nature whatsoever including legal fees incurred on account of alleging or resulting from your use or misuse of the website, using the Site to provide a link to another site or to upload content or other information to the Site, your breach of these Terms of Use, your violation of any third party’s intellectual property rights, or any disputes you may have with any other user of the website.

Account
If you use the Kulture House Dubai Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account from any devices, and you agree to accept responsibility for all activities that occur under your account or password. The Site shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.

Returns & exchanges
For online purchases, you will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and neither sellers nor Kulture House Dubai shall be liable for their loss or destruction.
In the unlikely event that you have purchased an item that is faulty, different to how it was described or shown, or you otherwise have a right to return it under any applicable law, it may be returned.
Please notify us of the return via email within twenty-four hours of the delivery of the goods in question.
Kulture House Dubai will offer a replacement or exchange the item. Alternatively, a refund or store credit for the net value of the item will be issued by Kulture House Dubai. The item must be returned to Kulture House Dubai at your cost via registered post or courier with all the labels attached and wrapped in their original packaging within ten days of receiving it. Any items accepted for return must not be used or reduced in value on your part.
If you change your mind, a return or refund can be issued provided the order is cancelled within twenty-four hours of placing the order. Once the order goes through and is ready for dispatch, the purchase cannot be cancelled.
In the unlikely circumstance that a product you have purchased is not available or out of stock, a refund of the same value will be offered to you.

Warranties & liabilities
Kulture House Dubai makes no warranty or representation of any kind, either express or implied, including but not limited to the warranty of title or non-infringement or implied warranty of merchantability, fitness for a particular purpose, non-infringement or other violation of rights in relation to the availability, accuracy, validity, reliability or content of these pages and/or the site.
Kulture House Dubai also does not make any representation or warranty regarding the accuracy or reliability of any advice, opinion, statement or other information that is submitted, displayed or uploaded through the site by any user.
You hereby warrant and confirm that you have the capacity and ability to agree to these Terms of Use and to carry out your obligations as set out in these Terms of Use.
You warrant that any material you upload onto the website shall not infringe the intellectual property rights of any third party.
You warrant, confirm and undertake that you will comply with all applicable laws, which you shall have the sole responsibility of familiarizing yourself with.

Site Operation
The United Arab Emirates is our Country of Domicile. Kulture House Dubai controls this Site from the U.A.E. Kulture House Dubai makes no representation that this Site is appropriate for use in other locations. If you use this Site from other locations you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials from this Site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.

Governing law & dispute resolution
The use of the Site and the Terms of Use are governed by the Laws of the United Arab Emirates, without regard to conflict of laws principles.
In the event of any dispute between you and us, we shall first attempt to resolve it amicably and in good faith. In the event that it is not possible to resolve any such dispute, then we agree that either one of us may refer any dispute arising out of or in connection with these Terms of Use, including any question regarding its existence, validity or termination, to be finally settled by binding arbitration by one (1) arbitrator in accordance with the rules of the Dubai International Arbitration Centre (DIAC).
The seat of arbitration shall be in Dubai and the arbitration shall be conducted in the English language and the arbitration award shall be final and binding on the parties.

Events beyond our control
We shall have no liability to you for any failure, breach or any delay of any nature whatsoever that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of information communication technology systems or network access, flood, fire, explosion or accident.

Purchases
Kulture House Dubai accepts payment by Visa or Mastercard debit and credit cards in AED for its products and services. All online purchases are also governed by the Terms and Conditions of respective merchant service providers. Please review the respective merchant service provider’s user agreement and privacy policy before entering any transaction.
Interpretation. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of Kulture House Dubai. All refunds will be made to the original mode of payment.

The displayed price and currency selected by you will be the same price and currency charged to the Card and printed on the Transaction Receipt.

Office Foreign Assets Control (OFAC) Sanctioned Countries:
Kulture House Dubai will not trade with or provide any services to individuals and companies owned or controlled by or acting for or on behalf of, OFAC targeted countries and individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country-specific.

Representations By You
By visiting the Site, you represent, warrant and covenant that (a) you are at least 18 years old; (b) that all materials of any kind submitted by you to Kulture House Dubai through the Site or for inclusion on the Site will not plagiarize, violate or infringe upon the rights of any third-party including trade secret, copyright, trademark, trade dress, privacy, patent, or other personal or proprietary rights. The customer using the website who is a Minor / under the age of 18 shall not register as a User of the website and shall not transact on or use the website.

By using the Site to search for or link to another site, you agree and understand that you may not make any claim against Kulture House Dubai for any damages or losses, corruption or interception of data whatsoever, resulting from your use of the Site to obtain search results or to link to another site. You understand and agree that in Kulture House Dubai’s sole discretion, and without prior notice, Kulture House Dubai may terminate your access to the Site, or exercise any other remedy available and remove any unauthorized user information if Kulture House Dubai believes that the information you provide has violated or is inconsistent with these Terms of Use, or violates the rights of Kulture House Dubai, or any third party, or violates the law. You agree that monetary damages may not provide a sufficient remedy to Kulture House Dubai for violations of these Terms of Use and you consent to injunctive or other equitable relief for such violations. Kulture House Dubai may release user information about you if required by law or subpoena.

Licence Granted To You
By providing materials to Kulture House Dubai, including by submitting or uploading content or materials for use on the Site you represent and warrant that you or the owner of all rights to such content or materials has expressly granted Kulture House Dubai an irrevocable worldwide right in all languages and in perpetuity to use and exploit all or any part of the content and materials provided by you.
